WAIT. SO NOW HE SHOULD BE IMPEACHED??

YES. Exactly. Why now? There’s only two weeks left in his term.

The president has proven dangerous to our democracy. Few could reasonably argue that he did not incite his followers to go to the U.S. Capitol to prevent the certification of electoral college votes necessary to transition power to the newly elected president. He told them to go. They did. They forced their way into the Capitol building, shoving past armed police officers, making their way onto the floors of both the House of Representatives and the Senate sending both chambers into emergency recess and their members into seclusion in safe locations.

Four people died and at least 14 law enforcement officers were injured.

Many legal scholars have labeled what the president did as sedition. It was. Here’s the definition:

Speech or conduct that incites people to rebel against a lawful authority.

Inciting people to rebel or resist governmental authority.

Legal Dictionary

In fact, Sedition is codified in the United States Code, section 2384, as

If two or more persons in any State or Territory, or in any place subject to the jurisdiction of the United States, conspire to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them, or to oppose by force the authority thereof, or by force to prevent, hinder, or delay the execution of any law of the United States, or by force to seize, take, or possess any property of the United States contrary to the authority thereof, they shall each be fined under this title or imprisoned not more than twenty years, or both.

Today, many in Congress have called for impeachment or for the imposition of the 25th Amendment. Could Congress convene and conclude an impeachment trial within the confines of the next two weeks? Yes, they could. Could a trial be concluded within that time frame? Yes. The new Congress has been convened. Democrats control both houses. Assuming no defections among the Democratic ranks, it would be possible to convict. It only requires a simple majority.

Here’s the benefit, though. Aside from removing a seditionist from office, the Senate can, as additional punishment, ban the president from holding federal elective office in the future. Trump has already signaled that he will run in 2024. Such a ban would snip such ambitions in the bud. That would not stop the equally, if not more, venomous Don, Jr. from running.
